Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-08-2021 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Sono P.S. Case No. 291 of 2019 instituted for the offences under Sections 147, 149, 341, 323, 307, 504 and 337 of the Indian Penal Code. Three persons including the petitioner are said to have assaulted one Bhagwan Mandal as a result of which, he has received injuries.

Learned counsel for the petitioner has submitted that an absolutely false case has been lodged against him. The injuries suffered by the victim are not in consonance

Patna High Court CR. MISC. No.752 of 2021(3) dt.13-08-2021 2/2 with the ocular testimony. Despite three persons having assaulted the victim, he has received only simple injuries though on the occipital region. Learned counsel for the petitioner has further submitted that the narration of events is not correct and such injury appears to have been caused in a different transaction but the petitioner has wrongly been made accused in this case.

Regard being had to the afore-stated facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Jamui, in connection with Sono P.S. Case No. 291 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure (Ashutosh Kumar, J) sunilkumar/- U T
