JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-06-2021 Heard Mr. Ranjan Kumar Jha, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Shahkund (Sajour) P. S. Case No. 99 of 2019, dated 20.04.2019, instituted for the offences under Sections 379 and 411 of the Indian Penal Code.

The petitioner has not been named in the F.I.R.

On suspicion, one Nitish Kumar was arrested and he appears to have named the petitioner. This is the reason for the prosecution of the petitioner.

Nothing has been recovered from the exclusive possession of the petitioner.

The petitioner has also come out with a positive reason why he has been named by the co-accused as one of his accomplices.

The petitioner is a student, who has a clean record.

Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bhagalpur in
