2. The petitioner seeks bail in connection with Session Trial No. 358 of 2022 arising out of Beldaur P.S. Case No. 101 of 2022 instituted for the offences under Sections 395/397 of the Indian Penal Code.
3. Earlier, vide order dated 28.02.2024 passed in Cr. Misc. No. 78887 of 2023, the petitioner was granted the privilege of anticipatory bail but he could not furnish bail bond as one of the condition/s imposed by this Court was not fulfilled.
3. Prosecution case, in short, is that, six unknown miscreants looted the Scorpio of the informant on the point of
Patna High Court CR. MISC. No.46054 of 2025(2) dt.24-07-2025 2/3 pistol and they also looted three mobile phones from three other persons.
4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Petitioner is not named in the F.I.R. The name of the petitioner transpired in this case on the basis of confessional statement of the co-accused Suman Kumar. Learned counsel further submitted that earlier, vide order dated 28.02.2024 passed in Cr. Misc. No. 78887 of 2023, the petitioner was granted the privilege of anticipatory bail with the condition that one of the bailors shall be his father. Learned counsel further submitted that father of the petitioner has already died on 10.01.2022 and due to the said reason he could not furnish bail bond as the condition imposed by this Court was not fulfilled. No incriminating article has been recovered from the conscious possession of the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.05.2025 and has no criminal antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case as also the period of custody undergone by the
Patna High Court CR. MISC. No.46054 of 2025(2) dt.24-07-2025 3/3 petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Session Trial No. 358 of 2022 arising out of Beldaur P.S.
