The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 323, 379, 307, 279/34 of the Indian Penal Code.

As per allegation in the FIR, due to rash and negligent driving, informant and his brother got injury. On asking by the accused persons that why they are driving so rashly, then accused persons assaulted them by lathi and rod. It is further alleged that co-accused Knachan Yadav has snatched his gold chain worth Rs. 47,000/-.

It is submitted by learned counsel for the petitioner that petitioner hs been falsely implicated in this case. The alleged occurrence took place at the spur of moment. Allegedly,

Patna High Court CR. MISC. No.45000 of 2022(3) dt.13-02-2023 2/2 petitioner has assaulted to Triloki Yadav by means of knife but his injury report is not available to the record. There is case and counter case. Petitioner is languishing in judicial custody since 21.06.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VIII, Siwan in connection with Raghunathpur P.S. Case No. 56 of 2022.
