JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-02-2017 This is an application for grant of anticipatory bail for offences punishable under Section 47(a) of the Excise Act. Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that nothing has been recovered from the possession of the petitioner. As such, petitioner has falsely been implicated in the present case. It is also submitted that petitioner had no knowledge of the case. Heard learned A.P.P. also.

Having heard both sides, in view of the fact that the case was instituted in the year 2006 and petitioner has come after 11 years for anticipatory bail, I am not inclined to grant

Patna High Court Cr.Misc. No.7472 of 2017 (2) dt.22-02-2017 2/2 anticipatory bail to the petitioner. However, petitioner may surrender in the court below, i.e., learned A.C.J.M-X, Ara, Bhojpur, in connection with Excise Case no. 21 of 2006 and make prayer for regular bail which will be considered by the court below itself on the basis of materials available on record and pass appropriate order without being prejudiced by the order of this Court.
