1. Heard learned counsel for the parties concerned.

The petitioner has filed the present writ application, being aggrieved by the order passed by the Panchayat Secretary, Gram Panchayat Raj Najari, Laxmipur, vide Memo No. 03, dated 08.04.2019, by which the Panchayat Secretary, Gram Panchayat Raj Najari terminated the services of the petitioner from the date of institution of FIR, being Laxmipur Police Station Case No. 69 of 2019, dated 22.02.2019, without awaiting the result of investigation or

Patna High Court CWJC No.14098 of 2019(3) dt.21-12-2023 2/2 without any show cause. The petitioner was working as Lok Sikshak in Lok Shri Kishan Kendra Rangnath Pahar, Kharagpur, Munger.

3. Learned counsel for the State submits that the District Teachers Appellate Authority has been constituted under the Rules for hearing the grievances of the teachers. The petitioner has directly approached this Court without availing the remedy before the District Teachers Appellate Authority.

4. In view of the aforesaid submissions, the present writ application is disposed with the liberty to the petitioner to approach the concerned District Teachers Appellate Authority against the impugned order.

5. It is made clear that if any appeal is filed by the petitioner, the District Teachers Appellate Authority shall dispose the same in accordance with law expeditiously, preferably within a period of six months.

6. With the aforesaid observation and direction, this writ application is disposed.
