The petitioner prays for anticipatory bail in connection with Alauli PS case no. 124 of 2016 registered for the offence punishable under sections 307 and other sections of Indian Penal Code and Section 27 of Arms Act.

It is submitted on behalf of petitioner that there is specific allegation against one co-accused who has fired and and this petitioner has not hit anybody. It is further submitted that informant is the cousin brother of the petitioner and dispute is with regard to fishing.

Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail.

Patna High Court Cr.Misc. No.16343 of 2017 (2) dt.08-04-2017 2/2 Having heard both sides. In view of the allegations leveled in the FIR, I am not inclined to grant anticipatory bail to the petitioner. As such, his prayer for anticipatory bail is rejected at this stage. However, he may surrender before the court below and pray for regular bail and the court below will dispose of the matter on its own merit without being prejudiced by the order of this Court.

With these observations, this bail application is dismissed.
