JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-09-2019 This application, for grant of anticipatory bail, arises out of Kesariya P.S. Case No. 123 of 2019, disclosing offences under Sections 304(B), 201 and 120(B) of the Indian Penal Code.
Petitioner happen to be in laws of the deceased and allegation against them is of causing dowry death of the deceased.
Submission of learned counsel for the petitioners is that they are in laws of the deceased and no allegation has been attributed to them and further the dead body was cremated in
Patna High Court CR. MISC. No.43311 of 2019(3) dt.13-09-2019 2/2 front of family members of the deceased, however, this false case has been lodged with ulterior motive.
Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-III, East Champarna, Motihari, in connection with Kesariya P.S. Case No. 123 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
