JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 01-09-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Lakhisarai (Kabaiya) P.S. Case No. 591 of 2020 registered for offence punishable under sections 66E, 67A of the Information Technology Act.

As per allegation, on mobile number of the informant mentioned in the FIR, some internet messages of obscene chatting with the informant's wife were received. From the other side, some photographs, audio clips and videos were obtained by hacking his mobile and caller demanded Rs.5,00,000/-, otherwise he threatened to share those information on social media platform. The learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent. The petitioner is a

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai (Kabaiya) P.S. Case No. 591 of 2020, subject to condition as laid down under section 438(2) Cr. P.C. Further condition is that if the petitioner is found involved in similar type of occurrence in future, the learned court below shall be at liberty to cancel the bail bond of the petitioner.

It is hereby made clear that this order shall not affect the departmental proceeding against the petitioner or the result thereof, if any.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
