JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 17-09-2016 The petitioner retired on 31.12.2009 from the post of In-charge, Head Clerk of Nagar Panchayat Office, Daudnagar, Aurangabad. He submits that he has not been paid retiral benefits like gratuity, provident fund. His pension too has not been fixed till date. Furthermore, the salary dues from February, 2007 to December, 2009 is pending. The petitioner fairly submits that he was also under suspension, but in the month of December, 2009, his suspension was recalled. Petitioner has also filed representations dated 24.7.2012, 18.2.2013, 25.3.2013 and lastly on 10.10.2013 to the Executive officer, Nagar Panchayat, Daudnagar for redressal of the grievances.

If the petitioner files a detailed representation before the Executive officer, Nagar Panchayt, Daudnagar (respondent no.2), the latter would consider the same and ensure payment of admitted dues within a period of two months from the date of receipt of a copy of the representation along with a copy of the order.

Patna High Court CWJC No.7458 of 2015 (3) dt.17-09-2016 The writ petition stands disposed of with the direction as above. Let a copy of the order be communicated to the Executive officer and the Chief Councillor, Nagar Panchayat, Daudnagar, Aurangabad (respondents no. 2 and 3).
