2. The petitioner is apprehending arrest in connection with Patliputra P.S. Case No. 258 of 2024, dated 30.06.2024, lodged under Sections 341, 323, 307, 302 & 34 of the Indian Penal Code, pending before the Court of Addl. Sessions Judge, Patna.

3. As per the prosecution, FIR has been lodged against unknown accused persons, who are alleged to have killed the informant's mother by strangulating her neck.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that the antecedent of the petitioner is clean. Counsel also submits that the petitioner's name has figured in this case

Patna High Court CR. MISC. No.43799 of 2025(2) dt.16-07-2025 2/2 solely by virtue of the confessional statement of the co-accused, and the petitioner is essentially a victim in the present case, as there is no material against him. It is further submitted that his name has appeared in this case under the allegation of conspiracy.

5. Learned APP for the State, on the other hand, opposes the prayer for bail of the petitioner and submits that the Trial Court, at the time of passing the order, called for the case diary, which categorically discusses the involvement of the petitioner in the present case.

6. In the present facts and circumstances, and in view of the discussion made by the Sessions Court in its rejection order, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is hereby rejected.
