JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 420 and 406/34 of the Indian Penal Code.
The prosecution case is that the complainant handed over rupees one lac sixty thousand to the petitioner and other accused for depositing in Common Weal Beverages Co. Ltd., a non-banking financial company but the petitioner supplied receipt of deposit of rupees eighty thousand only and rest amount was misappropriated.

No.17324 of 2016 (3) dt.26-04-2016 2/2 It is submitted by the learned counsel for the petitioner that the petitioner was simply an authorized agent of the aforesaid non-banking financial company and there is nothing on record to substantiate that the money was given to the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the thrust of accusation against the aforesaid non-banking financial company, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Barh, Patna, in connection with Complaint Case No. 447 C of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
