Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 387/34 of the Indian Penal Code and 27 of the Arms Act. The prosecution case is that co-accused Amarjit Singh, Samarjit Singh, this petitioner and two unknown person came and demanded extortion of Rs. 2,00,000/-, resorted to fire, causing injury to the brother of the informant Arun Kumar, who succumbed to the injury.
It is submitted by the learned counsel for the petitioners that the accusation is not specific against whose firing, the brother of the informant died. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.
Patna High Court Cr.Misc. No.3766 of 2016 (2) dt.25-01-2016 Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Chandradip P.S. Case No. 52 of 2015, pending in the court of learned Sri Lalan Kumar, J.M., Ist Class, Jamui.
With the above observation this application is disposed of.
