This application for anticipatory bail arises out of Garaul P.S. Case No. 09 of 2019 for the offence punishable under Sections 8/20 (b)(ii) (c) of the N.D.P.S. Act. It is alleged that one kilogram of ganza was recovered from the courtyard of the petitioner's dwelling house. Learned counsel appearing on behalf of the petitioner has submitted that in the Notification, dated 19.10.2001, issued by the Government of India, in exercise of powers under Clauses (viia) and (xxiiia), for ganza, quantity upto 1000 grams is to be treated to be small quantity. Considering the above submission and the punishment provided therefor, this application is allowed. Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below,

Patna High Court CR. MISC. No.43925 of 2019(3) dt.18-07-2019 2/2 be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. 1st -cum- Special Judge, Hajipur, Vaishali, in Garaul P.S. Case No. 09 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
