JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-03-2023 A jointness petition has been filed on behalf of the petitioner stating therein that informant is residing with his brother, who has received the notice and as such, notice may be deemed as validly served.

In view of the statement made in the jointness petition, notice is deemed as validly served upon the opposite party No. 2.

Despite valid service of notice, nobody appears on behalf of the opposite party No. 2.

Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for

Patna High Court CR. MISC. No.45378 of 2022(8) dt.20-03-2023 2/2 the offences punishable under Sections 498(A), 406, 506/34 and other sections of Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

Learned counsel appearing for the petitioner denies the prosecution case and submits that the petitioner is ready to keep his wife with full dignity and honour. Petitioner claims clean antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sheikhpura in Sheikhpura (Mahila) P. S. Case No. 25 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
