ANJANA MISHRA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in Athmalgola P.S. Case No. 48 of 2015 registered for offences punishable under Sections 363, 366(A) and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the victim girl had eloped with her son and in fact they are living happily together. It is further stated that petitioner is the mother of the boy who allegedly took away the victim girl. It is further stated that Petitioner's husband and father of the boy who had run away with the victim girl has been taken into custody. Learned counsel appearing on behalf of the State after perusal of the case diary submits that there is an admitted
Patna High Court Cr.Misc. No.4206 of 2016 (4) dt.26-04-2016 2/2 love affair between the victim girl Sanjana and son of the present petitioner.
Considering aforementioned facts and circumstances of this case and that petitioner's husband has been released on regular bail and the victim girl has already married with son the petitioner and living together let the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is/are directed to be enlarged on bail on furnishing bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Barh, in connection with Athmalgola P.S Case No. 48 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
