JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-08-2022 At the outset, the learned counsel for the petitioner seeks to add the Additional Chief Secretary, Rural Work Department, Government of Bihar, Patna as party Respondent No.5. Let the same be done during the course of the day. The present writ petition has been filed seeking the following reliefs:- "1. That this is an application for issuance of a writ or order or orders in the nature of mandamus for directing the respondents authority to include the water channel (pullia) i.e. minimum three Home pipe cause ways in the said road from Bathana Chauk to Vishunpur Khetal Masjit Tak as per notice No.

Patna High Court CWJC No.2318 of 2021(2) dt.10-08-2022 2/2 (RWD/ Muzaffarpur East-2/ MMGSY (SC)/ ReTender/04/2020-21 at Serial No.1 published in Daily Hindustan Newspaper Muzaffarpur dt. 11.05.2020 issued under the signature of Respondent No.-4 Executive Engineer, RWD(W) Division, Muzaffarpur East-2.

It is further prayed that during the pendency of the writ petition to stay the operation of the aforesaid notice with regard to serial no. 1 till the including of water channel (pullia) three Home pipe in road from Bathana Chauk to Vishunpur Khetal Masjid Tak in the light of aforesaid tender. As per tender notice road is not estimated as serial no.1 including the water channel in said road Batha Chauk to Vishunpur Khetal Masjid Tak."

After some argument, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Additional Chief Secretary, Rural Work Division, Government of Bihar, Patna i.e. the Respondent No. 5 for agitating his aforesaid grievances.
