JUSTICE SANJAY PRIYA ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Saharsa Sadar P.S. Case No. 865 of 2016 instituted for the offence under sections 307, 448, 34 of the Indian Penal Code. As per written report, there is specific allegation against co-accused Pradeep Sah of firing on the leg of the informant when he was in his shop. Co-accused Balram Sah fired which hit on chest of the husband of the informant and he became injured and fell down on the ground. The informant raised alarm and the accused persons fled away. There is allegation against this petitioner in the fard-beyan that he was also present at the time of occurrence.

Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.12202 of 2017 (2) dt.22-03-2017 2/2 prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Saharsa Sadar P.S. Case No. 865 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, subject to the conditions as laid down under Section 438(2) Cr.P.C.
