The petitioner is apprehending his arrest in connection with Jankinagar P.S.Case no.34 of 2016 registered for offences punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the FIR and later on his name transpired during the investigation of the case and there is recovery of a motorcycle from the Cow-shade.

Submission of the learned counsel for the petitioner is that after 10 months, he has been made accused on the basis of confessional statement and recovery is not from his house rather from the cow-shade.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.16914 of 2018 (2) dt.24-04-2018 2/2 circumstances, as stated above, this is not a case for grant of anticipatory bail rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit With the aforesaid direction, this application is disposed of.
