JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-03-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Mansahi P.S. Case No.08 of 2017 for the offences punishable under sections 341, 323, 354 (B), 379, 307 and 504/34 of the I.P.C.

It is submitted on behalf of the petitioner that there is case and counter case. Both sides have received injuries and now good sense has prevailed between the parties and both the parties have compromised the case and has filed compromise petition accordingly in the learned court below. The medical evidence does not support the prosecution story. There is no allegation that the petitioner repeated Khanti blow and as such under such

The learned A.P.P. fairly submits that the case has been compromised and the joint compromise petition has been filed in the learned court below, copy of which is Annexure-3. In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. A.C.J.M- VI, Katihar in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
