The petitioner being the brother of the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 328, 302 and 120B/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant after 14 years of marriage by administering poison.

It is submitted by learned counsel for the petitioner that only on suspicion the entire in-laws family has been made accused in the present case. The petitioner claims to be separate from the husband of the victim and the informant is

Patna High Court Cr.Misc. No.4862 of 2016 (2) dt.05-02-2016 2/2 not the eye witness to the occurrence. The impugned order also does not suggest any direct material collected during investigation against the petitioner.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Jalley P.S. Case No. 95 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
