JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 307, 386 and some other ancillary Sections of the Indian Penal Code and u/s 25(1b)a, 26, 27 35 of Arms Act. . As per the prosecution case, on 20.07.2021 in the evening while the informant was sitting in his office then two unknown miscreants riding on an Apache motor cycle came there and one of them fired at him and thereafter they fled away. Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation in the confessional statement of co-accused, Prabhat Kumar Jha, which

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Kadwa PS case No.191/2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
