28-01-2022 Heard learned counsel for the parties through video conferencing.
The petitioner seeks bail in Karakat P.S. Case No. 184 of 2020, registered for the offence punishable under Sections 324, 307, 302 and 34 of the Indian Penal Code. Later on, Sections 396 and 397 of the I.P.C. were added. As per the F.I.R., five unknown persons riding on three motorcycles intercepted the informant & his father and are alleged to have attacked them with knife, as a result of which, both of them sustained injuries and during treatment, father of informant died.
It is submitted on behalf of the petitioner that name of petitioner transpired during of course of investigation on the basis of confessional statement of co-accused Atal Bihari. No
Patna High Court CR. MISC. No.54006 of 2021(2) dt.28-01-2022 2/2 incriminating article has been recovered from the possession of the petitioner and till date, he has not been put on T.I.Parade. Similarly situated co-accused Dinesh Kumar has already been granted bail by this Court, vide order dated 04.01.2022 passed in Cr.Misc. No. 45234 of 2021. Petitioner is in custody since 20.01.2021. Chargesheet has already been submitted. Considering the aforesaid facts and circumstances, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge I, Rohtas, Sasaram / concerned court where the case is pending in connection with Karakat P.S. Case No. 184 of 2020.
