1. Heard learned counsel for the parties.
2. The petitioners in this application pray for bail apprehending their arrest in connection with Sahebpur Kamal P.S. Case no.131 of 2025 registered for the offence punishable under sections 191(2), 126(2), 115(2), 352, 351(1), 351(2) and 109(1) of the Bharatiya Nyaya Sanhita, 2023 and section 27 of the Arms Act.
3. As per the prosecution case, the informant states that eight named accused persons including the three petitioners herein were taking away the buffalo of the informant. They were
Patna High Court CR. MISC. No.43293 of 2025(2) dt.28-07-2025 2/3 variously armed with lathi, country made pistol etc. It is stated that on the villagers reaching and confronting them, they resorted to firing as a result of which some damage was caused to the electricity connection of the village.
4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case. Even accepting the allegations levelled in the FIR, admittedly no person was injured in the entire occurrence. The manner of occurrence is other than what has been narrated in the FIR. The allegations levelled against the petitioners/accused persons of having resorted to firing etc. are all false and concocted. The petitioners undertake to cooperate in the investigation/trial.
5. The application for bail is opposed by learned A.P.P. for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations levelled in the FIR, the allegations being general and omnibus in nature and specially no person having been injured in the entire occurrence, it is directed that all the three petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Sahebpur Kamal P.S. Case no.131 of 2025 on
Patna High Court CR. MISC. No.43293 of 2025(2) dt.28-07-2025 3/3 each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateIV, Begusarai. (Partha Sarthy, J) Saurabh/- U T
