JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 420, 406/34 of the Indian Penal Code.

The prosecution case is that Rs. 90,000/- was given by the informant to the petitioner for getting the informant employed in Japan.

It is submitted by the learned counsel for the petitioner that there is no proof with regard to payment and malicious prosecution appears from the fact that informant side have lodged three cases with same accusation, i.e., Andar P.S. case No. 156/ 2014, 157/ 2014 and present Andar P.S. case No. 158 of 2014 against the petitioner.

No.7406 of 2016 (2) dt.19-02-2016 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Andar P.S. Case No. 158 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
