Heard learned counsel for the petitioner and the learned counsel for the informant as well as learned APP for the State.

Petitioner seeks regular bail in connection with Kateya P.S. Case No. 171 of 2022 registered for the offences punishable under Sections 366(A), 504, 506 and 34 of the Indian Penal Code.

As per the prosecution, the informant's minor

Patna High Court CR. MISC. No.45576 of 2022(2) dt.30-11-2022 2/3 daughter aged about 17 years was kidnapped by this petitioner along with other co-accused persons.

The main submissions advanced by the learned counsel Mr. Lokesh Kumar Singh appearing for the petitioner are that the allegation made in the FIR is totally false, in fact the so-called victim was in love affair with this petitioner and she left her father's house at her own will and the allegation made in the FIR has been falsified by the victim's own statement given before the Judicial Magistrate.

Learned APP Md. Anbzarul Haque Sahara appearing for the State as well as learned counsel Mr. Pankaj Kumar Dubey appearing for the informant has opposed the bail prayer. Considering the above submissions and mainly the statement of the victim recorded before the Judicial Magistrate which goes against the allegation of the FIR and the said victim disclosed her age as 21 years before the Judicial Magistrate while recording her statement and she accepted her love affair with this petitioner, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection
