It has been submitted by the learned counsel for the petitioners that in Title Suit No. 143 of 1997, the evidence is complete and the arguments have already been advanced before another Sub-Judge and therefore, learned counsel further submits that the case is being delayed by the defendant of the title suit.

3. Learned counsel for the petitioner has further submitted that Respondent No. 5 under the influence of his father who is a life convict in Central Jail, Buxar, is trying to disturb the possession of the petitioner.

4. This kind of criminal activity has to be nipped at the bud.

5. The petitioner is directed to move before the Superintendent of Police, Bhojpur who will take necessary steps on the application of the petitioner.

6. The Sub-Judge, I, Dumraon, Buxar is directed to conclude the hearing of the Title Suit No. 143 of 1997 and decide the same within two months from the date of communication of this order. The Sub-Judge is also directed to proceed ex parte against the non-cooperating party.

7. It is made clear that the suit shall not be delayed by filing frivolous petition. If a defendant files any application, the same shall be dealt with by the Sub-Judge with the final judgment.

8. In view of the above, this application is disposed of.

9. Let a copy of the order be communicated to the District Judge, Buxar and also to the Superintendent of Police, Bhojpur at Ara through FAX/e-mail forthwith for compliance of the order.
