2. This application was filed by the petitioner for initiation of a proceeding of contempt against the Opposite Party No. 1, alleging willful and deliberate disobedience and non-compliance of the order and direction of this Court dated 26.08.2019 passed in CWJC No. 14528 of 2011.

3. By order dated 26.08.2019 passed in CWJC No.

Patna High Court MJC No.314 of 2021(3) dt.09-12-2025 2/3 14528 of 2011, the petitioner was directed to file a detailed representation within four weeks and the Principal Secretary Health and Medical Education, Government of Bihar, Patna was further directed to consider the same and dispose it of by passing a reasoned and speaking order in accordance with law. It was also directed that financial dues found admissible should be paid to the petitioner within a period of three months thereafter.

Learned Senior Counsel for the petitioner submits that the petitioner had filed representation and vide Annexure-A to the show-cause filed by Opposite No. 1, the representation filed by the petitioner has been rejected by a detailed order dated 27.09.2021. It is, therefore, prayed by learned counsel for the petitioner that since final order has already been passed on 27.09.2021 rejecting the representation of the petitioner, therefore, the petitioner does not wish to pursue this application and prays for liberty to challenge the order dated 27.09.2021 (Annexure-A to the show-cause filed by Opposite Party No. 1).

5. Learned counsel appearing for Respondent-State has no objection to the above submission made by learned counsel appearing for the petitioner.
