The petitioner is apprehending his arrest in connection with Mashrakh P.S. Case No. 155 of 2013 for the offences instituted under Sections 147, 148, 149, 353, 427, 435, 307, 379, 332, 333, 337, 338, 504 of the IPC and 3⁄4 of the Damage to Public Property Act.

The prosecution story, in brief, is that on 17.07.2013 at 7.30 A.M. the S.H.O. Mashrakh and police force was on duty in village-Gandaman Dharmasati with regard to investigate in Mashrakh P.S. Case No. 154/2013 and also to maintain the law and order. Suddenly the petitioner with other accused persons attacked on police force by bricks and stones. The mob was armed

Patna High Court Cr.Misc. No.5590 of 2016 (2) dt.28-03-2016 2/2 with lathi and bricks who assaulted the police force and set fire in police vehicle.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The nature of injury is said to be simple. The other co-accused have been granted anticipatory bail by this Court vide Cr. Misc. No. 43244 of 2015. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Mashrakh P.S. Case No. 155/2013 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Chapra, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
