JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2018 Petitioner apprehends his arrest in connection with Warsaliganj P.S.Case No. 48 of 2018 registered for the offences punishable under Sections 307/34 and later on Section 302 of the Indian Penal Code was added and 27 of the Arms Act. Allegation against the petitioner and other accused persons is that they have entered inside the house of the informant and one Shiv Nandan Chauhan has fired, causing injury and later on injured succumbed to the injury after 24 days. Submission of learned counsel for the petitioner is that there is no allegation of firing against the petitioner and allegation of firing is against Shiv Nandan Chauhan and earlier petitioner has lodged a case against the deceased.
Heard learned APP and learned counsel for the
Patna High Court Cr.Misc. No.26231 of 2018 (3) dt.27-06-2018 2/2 informant. They have opposed the prayer for anticipatory bail of the petitioner stating that earlier also they have killed son of the deceased.
Having heard both sides and in the facts and circumstances, let the petitioner, named above, surrender within a period of six weeks from the receipt of this order and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Nawada, in connection with Warsaliganj P.S.Case No. 48 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
