29-01-2022 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Mahkar P.S. Case No. 11 of 2020, registered for the offence under Section 302/34 of the Indian Penal Code.

As per the F.I.R., allegation against this petitioner is that she alongwith other family members tortured and harassed daughter of the informant and killed her due to non-fulfillment of demand of dowry. Husband of the deceased works in Surat. It is submitted on behalf of petitioner that petitioner is mother-in-law of the deceased and there is general and omnibus allegation of demand of dowry. No specific overt act has been alleged against this petitioner. During course of investigation, it has come that the deceased committed suicide. It is further

Patna High Court CR. MISC. No.55614 of 2021(2) dt.29-01-2022 2/2 submitted that when the informant realized the actual facts of the occurrence, a compromise petition was filed on 27.01.2021 by both the parties in the court below, vide Annexure - 2 to the petition. Petitioner is in custody since 24.02.2021. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Gaya / concerned court in connection with Mahkar P.S. Case No. 11 of 2020.
