This application, for grant of anticipatory bail, arises out of Kawakole Police Station Case No. 25 of 2014 disclosing offences under Sections 31,41,45,47 and 48 of the Forest Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case and nothing has been recovered from his possession and the tree has fallen due to storm. The occurrence took place on 22.01.2014 and the FIR has been registered on 03.03.2014. Similarly situated co-accused has been granted anticipatory bail vide B.No. 858 of 2014 on 17.01.2015.

Patna High Court Cr.Misc. No.6403 of 2017 (2) dt.20-02-2017 Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Kawakole Police Station Case No. 25 of 2014 subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
