Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioners seek regular bail in connection with Rail Thana Bhagalpur G.R.P. P.S. Case No. 26 of 2021 instituted for the offences under Sections 341, 323, 353, 427, 504 and 506/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners are in custody since 18.03.2021 and petitioner no. 1 has one criminal antecedent and petitioner no. 2 is a person with clean antecedent and charge-sheet has been submitted in this case.
The informant alleges that he was on duty at L.C.
Patna High Court CR. MISC. No.55131 of 2021(2) dt.21-02-2022 2/2 Gate 9B-2 (Sabour) and on the direction of the Station Master he closed the gate as train was to pass, when the petitioners came, abused and pushed him and asked him to open the gate, further on account of being pushed the receiver of phone was broken.
Learned counsel for the petitioners submits that petitioners have been falsely implicated and even presuming what has been alleged is true without admitting then the allegation is only of verbal duel between the petitioners and the informant with regard to opening of the gate, though the petitioners should not have done that.
Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.
In the nature of allegation as alleged in the FIR, let the petitioners above named be released on bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Bhagalpur in connection with Rail Thana Bhagalpur G.R.P.
