In this case, grievance has been made by the petitioner that the Sub-Divisional Officer, Araria has cancelled the P.D.S. licence of the petitioner on account of certain misdemeanour and though he has applied for the certified copy of the said order, but the same has not been given to him.

If an authority exercises jurisdiction and passes an order and the statute provides a forum of appeal or revision, the person who is aggrieved by the said order has a right to demand the certified copy of the order, otherwise it amounts to depriving the person to avail to forum of appeal.

Let the petitioner file a fresh application for certified

Patna High Court CWJC No.1991 of 2015 dt.29-06-2017 2/2 copy of the order along with the requisite Court fee. If such an application is filed, the Sub Divisional Officer or its Office will be obliged to supply the certified copy of the order within a period of one week from the date of filing of application by the petitioner. With the aforesaid observations and directions, this writ application is allowed.
