The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 380, 448 and 504 of the Indian Penal Code. The prosecution case is that on protest being made by the informant for abusing him, the accused persons assaulted the informant when informant's younger brother, Bhola Prasad, came to rescue he was also assaulted by the accused persons. It is alleged that the accused persons damaged the household articles and took away Rs.2500/- kept in a box.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.4581 of 2016 (2) dt.03-02-2016 2/2 petitioner that the injuries of the informant and his brother have been found to be simple in nature. The petitioner's side at earlier point of time, lodged Rajauli P.S. Case No. 56 of 2015 against the informant and others, wherein petitioner's side have also received injuries.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the case lodged by the petitioner's side at earlier point of time, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Rajauli P.S. Case No. 57 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
