NILU AGRAWAL ORAL ORDER 06-03-2019 Heard learned counsel for the petitioner, learned counsel for the Union of India and learned counsel appearing on behalf of private respondent nos. 5 and 6.

2. Vide order dated 04.12.2018, the matter was referred to Mediation Cell of the Patna High Court for settlement of dispute regarding post retiral benefit of the late employee Jagdish Kumar who died in harness from the post of Sub-Inspector on 16.09.2016. There was a dispute regarding payment of gratuity, GPF and Group Insurance whether the

Patna High Court CWJC No.9022 of 2018(3) dt.06-03-2019 2/2 petitioner is entitled to receive the same or respondent nos. 5 and 6 who are father-in-law and mother-in-law respectively of the petitioner.

A report dated 10.01.2019 has been received from the Mediator in Mediation Proceeding No. 190 of 2018 arising out of the present case wherein a settlement and agreement has been arrived between both the parties (petitioner and respondent nos. 5 and 6) as both have agreed to take the amount of gratuity, GPF and Group Insurance half and half.

4. Considering the report of the Mediator dated 10.01.2019, the petitioner and respondent nos. 5 and 6 are directed to appear before respondent no. 3, the Inspector General (Personnel), Central Reserve Police Force, Bihar Sector, Patna with the mediation report, which would be expeditiously acted upon by respondent no. 3 preferably within a period of two months from the date the petitioner and respondent nos. 5 and 6 jointly file their claims.
