JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-03-2017 This is an application for grant of anticipatory bail for offences punishable under Section 498A of the Indian Penal Code and 3 / 4 of the Dowry Prohibition Act.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that he is ready to keep his wife with him. Whenever petitioner tried to keep his wife with him, she left her husband and fled away. Heard learned A.P.P. also.

Having heard both sides, in view of the submission made above, petitioner is directed to surrender in the court below, i.e., learned A.C.J.M.-3, Sitamarhi, in connection with Riga P. S.

Patna High Court Cr.Misc. No.8770 of 2017 (2) dt.01-03-2017 2/2 Case no. 98 of 2016 and the court below will release the petitioner on provisional bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) with two sureties of the like amount each to its own satisfaction, subject to the conditions that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioner shall cooperate in the investigation and make himself available before the police as and when required and issue notice to opposite party no. 2. The court below will try to make settlement between the parties and since petitioner is ready to keep her, the court below shall watch their conduct for the next six months after calling them in the court on the date fixed on each and every month and if satisfied with the conduct of the petitioner, it will confirm bail bond of the petitioner, otherwise, court below will be at liberty to pass any order what it deems fit and proper.
