JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 376 of the Indian Penal Code.
The prosecution case is that the petitioner established physical relationship with the informant for the last 4-5 years prior to lodging of the case on promise of marriage but subsequently refused to marry.
It is submitted by learned counsel for the petitioner that informant is a married lady having children and the petitioner lodged a case against the informant and her sons on 31.07.2015 being Muzaffarpur SC/ST P.S. Case No. 73 of 2015 levelling accusations for offences punishable under Sections 420, 406, 341, 323, 504, 379/34 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act, whereas the present case has been lodged on 01.12.2015.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, 7th cumAdditional Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Mahila P.S.
