2. The petitioner seeks bail in a case registered for the offence punishable punishable under Section 414 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act.

3. Total 576 litres of Nepali liquor has been recovered from Tata Sumo vehicle.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. No incriminating article has been recovered from conscious possession of this petitioner. Petitioner is neither driver nor owner of the vehicle in question and he has got no concern with the seized liquor. Charge has already been framed. Petitioner is

Patna High Court CR. MISC. No.47313 of 2025(3) dt.25-11-2025 2/2 in custody since 19.03.2025.

5. Considering the facts and circumstances of the case and the period of custody, let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Special Judge, Exclusive Excise Court-02, Sitamarhi in connection with Pupri P.S. Case No. 231 of 2021.
