Petitioner seeks regular bail in connection with Revelganj PS Case No. 239 of 2021 registered for the offence under Sections 392 of the IPC.

Four unknown miscreants intercepted the informant and snatched his motorcycle, cash, mobile etc. on gun point. Learned counsel for the petitioner submits that petitioner is not named in F.I.R. and he has falsely been implicated in this case on the basis of confessional statement of the co-accused / Laxman Manjhi. He next submits that during the course of investigation it has been alleged that the looted motorcycle has been recovered from possession of the petitioner but the fact of the matter is that looted motorcycle has been

No.54106 of 2021(2) dt.17-05-2022 2/2 recovered from mango orchard where petitioner along with other co-accused persons were present and two of the coaccused persons allegedly fled away at the time of raid by police. He next submits that petitioner is in custody since 02-072021. The co-accused / Laxman Manjhi arrested along with the petitioner has been granted bail by this Court in Cr. Misc. No. 53377 of 2021.

Regard being had to the submissions made by the parties, taking into consideration the material on record, the fact that petitioner has got no criminal antecedent, he is in custody since 02-07-2021 , charge sheet has already been submitted and the co-accused has been granted bail, as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist Class, Saran at Chapra in connection with Revelganj PS Case No. 239 of 2019. praful/- (Anil Kumar Sinha, J) U T
