2. The petitioner seeks regular bail in Bahadurpur P.S. Case No. 134 of 2024 registered for the offence punishable under Section-30(a) of the Bihar Prohibition and Excise Act.

3. Allegedly, on the tip off, the informant along with police personnel raided the place of occurrence and seized a car from which, 500 litres of illegal liquor is said to have been recovered. from motorcycle of the petitioner. The petitioner is said to have been arrested on the spot.

4. Learned counsel for the petitioner has submitted that the petitioner is the person of clean antecedent. It has further been submitted that nothing incriminating has been recovered from conscious possession of the petitioner. The

Patna High Court CR. MISC. No.48872 of 2024(3) dt.02-09-2024 2/2 vehicle, in question does not belong to the petitioner. The petitioner is under incarceration since 30-03-2024.

5. Learned APP has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, specially, the criminal antecedent, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise, Patna City in connection with Bahadurpur P.S. Case No. 134 of 2024 subject to the condition that the petitioner shall cooperate with the trial and make himself available as and when required by the court.

7. Before accepting the bail bond, the criminal antecedent of the petitioner shall be verified from Sr. Superintendent of Police, Patna and if it is found that he is involved in any other case, his bail bond shall not be accepted.
