The petitioners are apprehending their arrest in connection with Barauli P.S. Case No. 209 of 2015 for the offences under Sections 304(B) and 201/34 of the Indian Penal Code.
The prosecution case, in brief, is that the informant Dashai Rai filed a written statement before the SHO, Barauli Police Station alleging that the marriage of his daughter, suman Devi was solemnized with accused Anil Rai. It is alleged that his daughter used to tell him that accused persons demanded motorcycle and chain in dowry for her marriage and lastly on
Patna High Court Cr.Misc. No.7243 of 2016 (3) dt.28-03-2016 2/2 1.11.2015 they killed her for want of dowry and to destroy the evidence, they burnt the dead body.
It is submitted by learned counsel for the petitioners that the petitioners have got no criminal antecedent. The petitioner no. 1 is sister-in-law, petitioner no. 2 is mother-inlaw and the petitioner no. 3 is dewar of the deceased. The petitioners are separate in mess and property from the husband of the deceased.
On behalf of the State, it has been submitted that the petitioners are named in the FIR.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Barauli P.S. Case No. 209 of 2015 on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
