JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 05-07-2024 Heard the parties 2.The petitioner is named in the F.I.R. and apprehending his arrest in connection with Sadar P.S. Case No. 297 of 2024 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2022.
3. The allegation against the petitioner is to be engaged in illegal trading/manufacturing of illicit liquor, where, there is recovery of 155.520 litres of foreign liquor.
4. It is submitted by learned counsel for the
Patna High Court CR. MISC. No.47485 of 2024(2) dt.05-07-2024 2/3 petitioner that the name of the petitioner appeared in this case o the basis of disclosure of Sunny Kumar and Prakash Kumar, in furtherance of which no incriminating appears to be recovered/surfaced during the course of investigation as to connect the petitioner prima-facie with present recovery of illicit liquor. It is further submitted that the petitioner further found involved in three more criminal cases in which he is on bail.
5. Learned APP, opposes the prayer of bail.
6. In view of above as save and except suspicion nothing appears against the petitioner, accordingly, the petitioner,in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge Court No.-I, Muzaffarpur/concerned Court, where the case is pending in connection with Sadar P.S. Case No. 297 of 2024,
