2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Hilsa P.S. Case no. 248 of 2024 instituted for the offence under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code.
3. The case of the prosecution is that the informant runs a dairy outlet. On the date of occurrence, the petitioner along with others went to the outlet and demanded curd. Informant replied that there was no supply of card. It is further alleged that other accused persons assaulted the staff of the
Patna High Court CR. MISC. No.46626 of 2025(2) dt.01-08-2025 2/3 informant. There is a specific allegation against one Shubham who took Rs. 29,400/- from the cash box.
4. Learned counsel for the petitioners has submitted that petitioners are innocent and have falsely been implicated in connection with the present case. During the course of argument, learned counsel for the petitioners has submitted that the father of petitioner no. 1 has already given Rs. 37,000/- as advance for curd and they were demanding curd. It is also submitted that the curd was being sold by the informant from the backdoor and the informant was refused to give curd. It is further submitted that similarly situated co-accused has been granted bail by this Court vide order dated 29.11.2024 passed in Cr. Misc. No. 78549 of 2024. Further submission is that the petitioners are having no criminal antecedents
5. Learned APP appearing for the State opposed the prayer of bail of the petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Hilsa P.S. Case no. 248 of 2024,
Patna High Court CR. MISC. No.46626 of 2025(2) dt.01-08-2025 3/3 he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial, Magistrate-I, Hilsa, Nalanda, subject to the conditions as laid down under section 438(2) of the Cr.P.C/ Section 482 (2) of the BNSS.
