JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-03-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Sahar P.S. Case No. 88 of 2016 for the offence punishable under section 304 (B)/34 of the I.P.C.

Sarita Devi, the daughter of the informant, was married to Bhim Singh in the year 2010 and after the marriage the husband Bhim Singh was demanding dowry and due to non fulfillment he used to torture and assault his wife. Mother-in-law, father-in-law and other in-laws also used to torture and assault her and ultimately on 23.08.2016 they killed her by hanging. Submission is of false implication and that the

No.10943 of 2017 (2) dt.18-03-2017 2/2 petitioner, an old father-in-law, is living separately from the deceased and her husband since long, against the petitioner there is general and omnibus allegation, specific allegation is against the husband who is in custody and as such the petitioner deserves sympathetic consideration.

The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner.

In the facts and circumstances as stated above, considering that the petitioner is an old father-in-law, as submitted, and as such the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. A.C.J.M. Xth, Bhojpur at Ara in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
