The petitioner seeks bail in Dharaiya P.S. Case No. 211 of 2020, registered for the offence under Section 379 of the Indian Penal Code.

As per the F.I.R., some unknown persons committed theft of motorcycle of the informant.

It is submitted on behalf of petitioner that name of the petitioner has come on the basis of confessional statement of coaccused Abhishek Kumar, from whose possession, the stolen motorcycle was recovered. No incriminating article has been recovered from the possession of the petitioner. Petitioner has got clean antecedent and he is in custody since 31.07.2021. Learned A.P.P. for the State has opposed the bail petition.
