JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-07-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 28.12.2020, within four weeks of starting of Court proceeding in physical mode in normal course. Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends her arrest in connection with Hussainganj P.S. Case no. 212 of 2020, registered under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code.
The accusation is that nine persons named in the F.I.R., including the petitioner, having Lathi, Farsa, Daab and rod, in their hands, came at the door of informant Aftab Ahmad
Patna High Court CR. MISC. No.40503 of 2020(2) dt.23-07-2021 2/3 and started to abuse, when the informant made protest then Raees Ahmad gave Farsa blow at his head then he fell down. Thereafter, Ekbal Ahmad fired through pistol, but it was misfired, others also caused injury to him through Lathi. When his wife and son Kamre Alam rushed to save then Ebrar Ahmad gave Daab blow at the head of his son Kamre Alam. At that time, Niloo Khatoon (Petitioner) gave rod blow upon the leg of the informant's wife and when she fell down she snatched her gold chain.
Learned counsel for the petitioner submits that at the time of occurrence, it is alleged that petitioner caused injury through rod at the leg of informant's wife and she also snatched gold chain from the neck of wife of informant, but there is no injury on the person of wife of informant. Further submission is that petitioner being lady has falsely been implicated in this case case with ulterior motive. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like
