The petitioner apprehends his arrest in connection with Beur P.S. Case No.191 of 2021, registered for the offences punishable under Sections 341, 323, 376, 504, 506 and 34 of the Indian Penal Code.

The petitioner is said to have committed rape with the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. There is general and omnibus allegation against the petitioner. It is further submitted that medical report does not support the prosecution case and petitioner is the devar of the victim. It is also submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application.

Patna High Court CR. MISC. No.55215 of 2021(4) dt.08-08-2022 2/2 Learned APP for the State as well as learned counsel for the informant opposed the prayer for anticipatory bail of the petitioner and submitted that the victim has supported the prosecution case in her statement recorded under Section 164 Cr.P.C.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
