The petitioners apprehend their arrest in Deo P.S. case No. 11 of 2017 under Section 307, 353 and other Sections of the Indian Penal Code.
The S.H.O. of Deo P.S. alleged that he got information that a boy was crushed to death by a speedy truck near Deo Godam. The mob assembled there and set ablaze the truck. The also pelted stones on the police personnel. The learned counsel for the petitioners submits that, of course, the petitioners are named in the FIR but Abhishek Kumar, nephew of petitioner No.2, was crushed to death and the petitioners had gone there to bring the dead body of Abhishek and
Patna High Court Cr.Misc. No.18236 of 2017 (2) dt.18-05-2017 2/2 they have been made accused in the case. It is further submitted that similarly situated accused Dharmendra Choudhary and six others have already been granted anticipatory bail vide order dated 12.04.2017 passed in Cr. Misc. No. 15244 of 2017. Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Aurangabad in Deo P.S. Case No. 11 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
