JUSTICE SANJAY PRIYA ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Excise Case no. 17C3 of 2016 instituted for the offence under Section 47(a) of the Excise Act.

It is alleged that 15 litres of illicit country made liquor along with two glasses were recovered from the house of the petitioner and petitioner managed to run away. From para-3 of the petition it is apparent that he is also accused in other cases of Excise Act.

Considering the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, the same is rejected.

However, petitioner may surrender in the court below, i.e., Chief Judicial Magistrate, Khagaria, in connection

Patna High Court Cr.Misc. No.14528 of 2017 (2) dt.29-03-2017 2/2 with Excise Case no. 17C3 of 2016 and make prayer for regular bail which shall be considered on its own merit without being prejudiced by the order of this Court.
